New Jersey Family Courts
New Jersey family courts are under the Family Division of the Superior Court. This court hears cases related to the family. Family law cases are heard in the court that has jurisdiction based on your residency, for the most part. State statute L.1983, c.405 established the Family Division of the Superior Court. Accordingly, the Domestic Relations Court and County Juvenile Court have been abolished and brought into the Family Division. Some family law matters the Family Division has jurisdiction over include:
- Adoption
- Divorce and related issues
- Juvenile law matters
- Domestic violence matters
- Child support and custody issues
- Enforcement order and modifications.
What to expect in NJ family court
The Family Division of the Superior Court functions similarly to other courts in New Jersey. Most family cases are civil cases and resolve disputes related to marriages, children, and domestic partners. Cases are often open to the public. In some cases, courts are closed off when they want to protect the privacy of a child. There is no jury and most cases are decided by a judge. Similar to other NJ courts, each case is documented with a docket number. When you go to court, you are obligated to follow the rules and traditions of that court. You must show up on time and act in a respectful manner. If you are late or do not show, a judge has the discretion to decide against you with a default judgment, except in cases involving military members. Similar to other New Jersey courts, at the discretion of the judge, the Family Division of Superior Court allows pre-trial, trial, and post-trial motions. Parties have the right to appeal judgments. When a court hears a case related to children, they will always have the child’s best interests in mind. Some county family courts offer free childcare for parents or guardians who are in court.
