When custody and parenting time is at issue in a contested divorce, the first step is to attend court-ordered mediation at the court house. The parties attend without their lawyers. If mediation is successful, the court appointed mediator will draft a consent order resolving all issues. In the event they are unsuccessful, the parties return to the judge who will then order custody evaluations to determine what is in the best interest of the children. The custody evaluator will make recommendations. If the parties accept them, hopefully the matter will be resolved. In the event the recommendations are not accepted, each party has the right to hire a rebuttal expert and go through another custody evaluation. At that point, a trial would become inevitable.
