Many people come into my office very hurt and very angry with stories of how their spouse has been unfaithful. The main thing they want to know is, “Can I punish my spouse? Can I get more from the court knowing that my spouse has done something wrong?” Unfortunately, the court does not take fault into consideration when considering the issues of your divorce, including alimony and equitable distribution. The court does not seek to punish. However, in the event there was some wrongful dissipation of your marital assets, you may be able to achieve some type of credit towards the assets that your spouse wrongfully took. Otherwise, fault really won’t play much of a role in your divorce.
