Unlike child support, there are no guidelines for alimony. Rather, it is based on statutory factors. When determining an alimony payment, courts will examine factors, including the ages of the parties, the educational background of the parties, the health of the parties, and the duration of the marriage. In addition, alimony is paid in several different types of ways. Rehabilitative alimony is for a spouse who has been a stay-at-home parent or out of the workforce for quite some time. Maybe some rehabilitation alimony would be factored into the payment to give this person a chance to better themselves.
There is limited-durational alimony for shorter marriages. Now we have what is called open-duration alimony. They have done away with what used to be permanent alimony. In open-duration alimony, the alimony is payable over a certain period of time until such time where there is a change of circumstances, including retirement or some kind of disability. At that point, the alimony would be re-evaluated to determine if it should be continued or modified. In addition, there are several factors that would terminate alimony, including if the recipient spouse remarried or if there was an enhanced income from the rehabilitation that the spouse received. Alimony is not a set amount. It is really based upon several circumstances and factors. The court will look at your particular case to decide what type of alimony is appropriate in your divorce agreement.
