Disability discrimination is when your employer treats you differently or poorly because of your having a disability. It also could be that the employer treats you differently because he perceives you as having a disability, even when you don’t. I’ve handled cases where people were not disabled but they returned from a leave of employment and were treated differently. Let’s say they had a heart attack and they came back to work. The boss began giving them less work, less important decisions to make, and making life miserable for them in many ways. For some reason, the employer perceives them as having a disability. Perhaps you do have a disability and the employer shows their annoyance at your disability. Perhaps you are getting paid less. Perhaps you are going to be terminated because of your disability. That is what disability discrimination is and it’s against the law.
